At the Divorce Court on Wednesday even ing before His Honor Mr. Justice Hodges some time was taken up. with the hearing of a petition for dissolution of marriage filed by

a mining manager namod Zechariah Hollow, of New Chum, and a counter petition by his wife, Margaret Hollow, —nee Mrs.' Cattran. The grounds for separation were alleged to be desertion for three, years and upwards. The facts of the case were given in yesterday’s issue.. . Brieflythey are that in 1887. at Sandhurst, the parties word 'married, Hollow being at the time of his marriage a widower with five 'children, and -his 'wife a widow, re- siding with her two children Bolt-street Long Gully. According to the evidence they had been but four days united when petty differences rose through the quarrelling of the children, and a slight dispute about an addi- tion to a bouse, and they separated. His Honor, on the.flrst hearing of the case, intimated that he would 'reserve his decision until, yesterday and he proceeded to deliver it on the opening of the court. In doing so, he pointed out that the petitioner’s reason for marrying, as given by himself—to the effect that he wanted someone to do the housework to save his daughtcr—suggested that he did not marry for the only reason man was sup- posed to marry—because he loved the person he married. He had admitted, in fact, that he wanted someone to work for him who would not require payment for it, instead of employ- ing a domestic servant, he married in order to procure a slave. Was it at all unlikely then the learned judge asked that differences - should arise?- He was inclined to the opinion that the woman hadabundant cause to leave her hus- band's house, and on that ground he dis- missed the petition with costs. There was a counter petition which head .not been pressed much and, which, he considered did not re-’ veal sufficient reason why the marriage should be dissolved. Persons must undorstand that the Divorce Court could not be used as a place to settle petty private squabbles and. because two natures did not agree and the marriage was : ill-assorted that was not the place to seek release. The marriage tie' was intended as a solemn contract by the Legis- lature at the present time oven to be a tie for life. He would dismiss the counter petition and any extra costs which might be incurred would ave to be borne by the petitioner. Mr Roberts said that an application had been made in chambers for a guarantee for costs to be launched, but His Honor intimated that this was nothing to do with him and each party would have to pay their own costs. Hollow had first brought the law into motion and he should be made to pay the costs of the first petition. In this case Mr. J. B. Roberts instructed by Messrs. Connelly and Tatchell, appeared for Hollow and Dr. Quick, instructed by Mr. Hyett, for the wife.
